1. General provisions
- These terms set out the rules for filming dogs’ runs at agility competitions and preparing video reels from the footage.
- Booking the service means accepting these terms and the conditions of the offer, without prejudice to statutory consumer rights.
2. Scope of the service
- The service covers filming the specified dog, selecting the material and editing a reel in line with the offer for the given event.
- The service documents the dog’s actual run. The Provider performs it with due care but does not guarantee a particular result or a particular way of taking the obstacles.
3. The dog’s run and preferred shots
- During a competition a dog may make mistakes, miss a contact zone, knock down or refuse an obstacle, run more slowly, jump in a different position than expected or not finish the run. These are part of the actual run. Dissatisfaction with the pace, jumping technique, the dog’s position, the contact zones or other elements of the run is not, in itself, grounds for considering the service to have been performed improperly.
- The Customer may indicate preferred shots, e.g. the dog walk, the weave poles or a jump. The Provider will make every effort to include them, as far as conditions and technical possibilities allow. Indicating a shot does not guarantee any particular behaviour of the dog at that spot.
4. Booking and payment
- A booking reserves the Provider’s time and is a commitment to buy the service at the price stated before booking, without prejudice to statutory consumer rights.
- In the booking form the Customer gives correct details identifying the dog: its name, breed, height and the class it competes in. The Customer passes the start number on to the Provider as soon as they receive it.
- The Customer gives a correct e-mail address. The Provider sends the booking confirmation to this address and uses it for contact about the service. The Provider is not responsible for a lack of contact resulting from an incorrect address.
5. Cancelling on the day of the competition
- The Customer may cancel the reel free of charge because they are dissatisfied with the dog’s run, if they inform the Provider on the day of the competition, promptly after their run and before the selection or editing of the material has begun.
- The cancellation must be stated clearly, directly to the Provider or through the contact channel given when booking. Absence of information is not treated as a cancellation.
- A cancellation made after the day of the competition or after editing has begun is not grounds for cancelling the order or refunding the fee solely because of dissatisfaction with the dog’s run, without prejudice to statutory consumer rights.
6. Delivery and corrections
- The Provider chooses the shots and the editing approach, taking into account the Customer’s preferences and the technical quality of the material. Use of every fragment of the footage is not guaranteed. Raw footage is not handed over unless the offer states otherwise.
- The Customer may submit specific comments on the edit within 3 days of receiving the reel. One round of minor corrections is included if the offer provides for it. Corrections do not include changing the dog’s actual run or filming the competition again.
7. Circumstances beyond the Provider’s control
- Filming may be hindered or impossible for reasons beyond the Provider’s control, e.g. changes to the schedule, restrictions imposed by the organiser, weather conditions, obstructions in the field of view or equipment failure despite due care. In the event of a technical problem, the Provider will take reasonable steps to recover or use the available material.
8. Complaints and consumer rights
- The Customer may file a complaint about the footage or the edit not conforming to the agreed scope. Complaints are handled in accordance with applicable law.
- These terms do not limit statutory consumer rights, including any right to withdraw from a distance contract. If the service is to begin before the withdrawal period expires, the Provider will give the required information and obtain the appropriate statements where the law requires it.
9. Material and publication
- The Customer receives the finished material to the extent set out in the offer. Additional versions or materials may be subject to an extra fee.
- Use of the footage in the Provider’s portfolio or social media is based on separate consent, where required. Promotional consent is not a condition of buying the service.
10. Acceptance of the terms
Before sending the booking, the Customer ticks the box “I have read the competition booking terms and accept them” in the form. Without it the booking will not be accepted. By accepting the terms, the Customer confirms in particular that:
- the service covers filming and editing the dog’s actual run, not a guarantee of a sporting result or of a particular way of taking the obstacles;
- indicating a preferred shot concerns the place or type of shot, not a guarantee of any particular behaviour of the dog;
- a cancellation of the reel because of dissatisfaction with the dog’s run must be made on the day of the competition, promptly after the run and before selection or editing begins;
- they were informed of the price of the service before booking.
If the service is to be performed before the statutory withdrawal period expires, the Provider will ask the Customer for a separate statement, in accordance with point 8.
